Should I settle while I'm still in treatment?

Injured in a Springfield accident? Free consultation with Attorney Daniel A. Pava. No fees unless we win.

Usually, no. Once you sign a settlement and release, it's final. If you settle before you know how your injury will turn out, you can't go back for more money if you later need surgery, more therapy, or time off work.

Why insurers offer early settlements

A quick offer can feel like a relief, especially when bills are piling up. But insurance companies make early offers because they're usually cheaper. They know your total medical costs and long-term effects aren't clear yet.

When is the right time?

Most cases are best valued once you reach what doctors call "maximum medical improvement." That means you've healed as much as you're expected to, or your doctor can predict the care you'll need in the future. At that point, we know the full cost of your injury.

But don't wait too long

In Massachusetts, you generally have three years from the date of the accident to file a lawsuit. Long treatment doesn't pause that clock. If your treatment is still going near the deadline, a lawsuit can be filed to protect your rights while your care continues.
